MASSACHUSETTS INSTITUTE OF TECHNOLOGY RESEARCH REACTOR CLOSURE OF CONFIRMATORY ACTION LETTER NO. NRR-02-005 ON THE SITE-SPECIFIC COMPENSATORY MEASURES IMPLEMENTATION PLAN

Dear Mr. Foster:

The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has closed Confirmatory Action Letter (CAL) No. NRR-02-005. The NRC issued CAL No. NRR-02-005 on October 28, 2002 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML022810675). This confirmatory action letter formalized commitments to implement site-specific compensatory measures related to security and safeguards.

By letter dated June 11, 2019 (ADAMS Accession No. ML19165A028), the NRC received a revised physical security plan (PSP) for the Massachusetts Institute of Technology Research Reactor (MITRR), under Facility Operating License No. R-37. In response to this letter, the NRC staff reviewed the MITRR PSP, dated May 1, 2019, and found it to be in compliance with the applicable regulations contained in Title 10 of the Code of Federal Regulations (10 CFR)

Part 73, Physical Protection of Plants and Materials. In addition, the NRC staff found that the MITRR PSP also incorporated all of the site-specific compensatory measures committed to in CAL No. NRR-02-005. Therefore, the NRC considers CAL No. NRR-02-005 closed.

Under 10 CFR 2.390, Public inspections, exemptions, requests for withholding, the NRC will make a copy of this letter available electronically for public inspection in the NRC Public Document Room located at the NRC Headquarters in Rockville, MD. The public can also access this letter in the NRCs document system, ADAMS, which is accessible from the NRC Web site at https://www.nrc.gov/reading-rm/adams.html.
