Dear Mr. Freudenberger:

In response to your letter to the U.S. Nuclear Regulatory Commission (NRC) dated May 8, 2019 (Ref. 3), the Office of Nuclear Material Safety and Safeguards, Division of Spent Fuel Management, Inspections and Operations Branch staff has reviewed Revision 18 of Nuclear Fuel Services (NFS) Quality Assurance Program (QAP) for Shipping Packages for Radioactive Material (Ref. 2). The staff assessed that the revised Section 7.0, Control of Purchased Material, Equipment, and Services now adequately addresses the qualification requirements for Important-to-Safety Category A component suppliers.

The unresolved item (URI) in Inspection Report 71-0249/2017-201 (Ref. 1) regarding regulation Title 10 of the Code of Federal Regulations (10 CFR), 71.115, Control of purchased material, equipment, and services, has now been clarified and resolved with the updating of Section 7.0 of the NFS QAP. The URI is now closed along with the inspection performed July 24-27, 2017.

The inspection is now officially closed with only one non-cited Severity Level IV violation and one minor violation of NRC regulations.

Since the changes made in Section 7.0 of the NFS QAP in Revision 18 are an increase in commitments on NFS part, in accordance with regulation 10 CFR 71.106(b), NFS will not be receiving from the NRC an updated Form 311 approving the changes.
