have a license t o receive and handle byproduct material.
This l e t t e r i s t o remind you of your responsi bi 1 i t i e s under the Atomic Energy Act of 1954, as amended, and the requirements of 10 CFR 40.51.
Paragraph 40.51 prohibits transfer of source or byproduct material t o another person or f a c i l i t y unless they hold a valid license.
This requirement applies t o small quantities of tailings t h a t would be sent t o a laboratory for testing or t o any other f a c i l i t y because there i s no provision t o exempt byproduct materi a1 from 1 i censi ng requi rements.
Laboratories i n Agreement States, including Texas, Colorado, Washington, and I l l i n o i s, should be licensed by t h a t State.
All other laboratories should have a specific license issued by the NRC.
