Paragraph 40.51 p r o h i b i t s t r a n s f e r of source or byproduct material t o another person or f a c i l i t y unless they hold a valid l i c e n s e . This requirement a p p l i e s t o small q u a n t i t i e s of t a i l i n g s t h a t would be sent t o a laboratory f o r t e s t i n g or t o any o t h e r f a c i l i t y because t h e r e i s no provision t o exempt byproduct materi a1 from 1 i censi ng requi rements.
Laboratories i n Agreement S t a t e s , including Texas, Colorado, Washington, and I l l i n o i s , should be licensed by t h a t S t a t e . All o t h e r l a b o r a t o r i e s should have a s p e c i f i c l i c e n s e issued by the NRC. Accordingly, please v e r i f y t h a t any l a b o r a t o r i e s t h a t perform mill t a i l i n g s t e s t i n g f o r you hold a v a l i d 1 i cense.
