MAINE YANKEE ATOMIC POWER COMPANY EXEMPTION REQUEST FROM CERTAIN REQUIREMENTS OF 10 CFR 72.212 AND 10 CFR 72.214 FOR THE INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Mr. Dostie:

I am writing in reference to your letter dated January 29, 2019 (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML19038A057), to the U.S. Nuclear Regulatory Commission (NRC) regarding Maine Yankee Atomic Power Companys (Maine Yankee) request for an exemption from certain NRC requirements for storage of spent nuclear fuel. Specifically, Maine Yankee requested that the NRC issue four exemptions for Amendment No. 6 to Certificate of Compliance (CoC) No. 1015, each of which were previously approved for Amendment No. 5 to CoC No. 1015. In your letter, you discussed your review of Maine Yankees exemption request and noted that there were no increased radiological consequences or risks in public health and safety associated with Amendment No. 6 to CoC No. 1015 above and beyond what has already been analyzed and approved. Based on your review, you indicated that the State has no objections to Maine Yankees exemption request as the exemptions appear to be an administrative change to maintain consistency with the canister manufacturers CoC.

Enclosed is a draft notice that will be published in the Federal Register in the near future. I am providing you a copy of this draft notice as a courtesy. The NRC has completed its review and has determined that granting these exemptions will not result in any significant impacts to public health and safety, and the environment. The exemptions will be effective immediately upon publication in the Federal Register.
