BENNETT SECURE TRANSPORT, LLC - TRANSFER OF CUSTODY OF IMMOBILIZATION DEVICE
Dear Mr. Bennett:
On June 11, 2019, a notification was submitted with supplemental information (Agencywide Documents Access and Management System (ADAMS) Accession No.: ML19168A179) to the U.S. Nuclear Regulatory Commission (NRC) regarding a transfer of custody of an immobilization device from Wilcox Truck Line (WTL), Inc. to Bennett Secure Transport (BST),
LLC. This immobilization device is to be used on transport vehicle(s) for the transportation of spent nuclear fuel (SNF) pursuant to Title 10 of the Code of Federal Regulations (10 CFR),
Paragraph 73.37(c)(4). The NRC previously approved this immobilization device on November 13, 2017, (ADAMS Accession No.: ML17317A346), for use by WTL.
The NRC staff has reviewed the information submitted by BST. Based on the NRCs review and BSTs commitment that there have been no changes to the immobilization device previously approved by the NRC, the NRC has no objection to the transfer of custody of the device from WTL to BST for use on the transport vehicle to permit immobilizing the cab during SNF shipments. The NRCs prior approval of the immobilization device remains unchanged.
As a reminder, in accordance with 10 CFR Paragraph 73.37(c)(5), the physical protection system for a shipment of SNM must provide that the transport vehicle driver has been familiarized with, and is capable of implementing, transport vehicle immobilization, communications, and other security procedures.
In accordance with 10 CFR, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system ADAMS. ADAMS is accessible from the NRC Web site at:
