U.S. NUCLEAR REGULATORY COMMISSION PROPRIETARY DETERMINATION LETTER FOR INFORMATION SUPPORTING THE MAY 30, 2019, MEETING ON WCAP-16097, COMMON QUALIFIED PLATFORM TOPICAL REPORT WATCHDOG TIMER REVISION (EPID: L-2019-TOP-0012)

Dear Ms. Zozula:

By letters dated May 16, 2019 (LTR-NRC-19-25) and May 22, 2019 (LTR-NRC-19-26)

(Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML19143A276 and ML19137A063), Westinghouse Electric Company (Westinghouse) submitted information supporting the May 30, 2019, meeting on WCAP-16097, Common Qualified Platform Topical Report, watchdog timer revision. Also submitted were two affidavits dated May 16 and May 21, 2019, executed by yourself, requesting that the information in the subject submittals be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations Section 2.390 (10 CFR 2.390).

A nonproprietary copy of the meeting slides provided in the May 16, 2016, letter has been placed in the U.S. Nuclear Regulatory Commission (NRC) Public Document Room and added to the NRC Library in ADAMS Accession No. ML19137A064. A nonproprietary version of the planned revisions document provided in May 22, 2019, letter was not provided. Westinghouse stated in its May 22, 2019, letter that there was so much proprietary information that a redacted version would have been nonsensical.

Westinghouse detailed the reasons for withholding in its affidavit.

The NRC staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390. Based on the statements in the affidavit, the NRC staff has determined that the submitted information contains proprietary, commercial information and should be withheld from public disclosure.

Therefore, the submitted information marked as proprietary will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the agency may send copies of

C. Zozula this information to its consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC staff.

You also should understand that the NRC staff may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
