Title:
Meeting to discuss staff review and status of Regulatory Guide 5.81 and status of three open the Design Basis Threat issues.
Date of Meeting: May 15, 2019 Location: NRC Headquarters, 3WFN 8th floor conference room Type of Meeting: Closed. The discussion involved security-related topics and addressed issues identified as Sensitive Unclassified Information which is exempt from public disclosure.
Purpose of the Meeting: Discuss the staffs review and status of Regulatory Guide 5.81, Target Set Identification and Development for Nuclear Power Plants. Additionally, the staff provided the status of three Design Basis Threat issues determined to be potential backfit by the Committee for Review of Generic Requirements.
Summary: On May 15, 2019, U.S. Nuclear Regulatory Commission (NRC) staff conducted a closed public meeting with stakeholders from the Nuclear Energy Institute (NEI), NextEra, Entergy and the Union of Concerned Scientists (UCS). Approximately 40 people participated in the meeting. The meeting notice and agenda are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML1911A034. A list of attendees and the NEI presentation are provided as enclosures. After introductory comments by the Director, Office of Nuclear Security and Incident Response (NSIR), the staff presented an overview of current NRC efforts related to the review and status of Regulatory Guide 5.81, Target Set Identification and Development for Nuclear Power Plants. Additionally, the staff provided the status of three Design Basis Threat (DBT) issues determined to be potential backfit by the Committee for Review of Generic Requirements (CRGR).
The NRC staff provided an update concerning the status of three DBT issues which were previously part of a revision to Regulatory Guide 5.69, Guidance for the Application of the Radiological Sabotage Design-Basis Threat in the Design, Development and Implementation of a Physical Security Program that Meets 10 CFR 73.55 Requirements. Because of a review by the CRGR, these items were determined to be a potential backfit. Staff discussed the status of the three items and next steps. A second presentation related to Regulatory Guide 5.81 addressed ongoing efforts in the staffs review and update of the guide. The following topics were discussed: 1) Reasonable Assurance; 2) Procedures versus Guidance; 3) Emergency Preparedness Activities; 4) Changes to Precluding Adversary Interference (Criterion III); and
- 5) Crediting of Active Features and 6) Local Law Enforcement Involvement and Capabilities.
The NEI presentation covered their response to NRC questions raised at a December 17, 2018, meeting and proposed recommended changes to Regulatory Guide 5.81. NEI also requested the NRC to incorporate guidance in NUREG/CR-7145 to better determine adversary timelines.
Another recommendation was to consider target set characterization in the design of site protective strategy.
Following each presentation there was a short question and answer discussion. The NRC staff informed the stakeholders that future meetings would be held regarding the status of each topic addressed.
