U.S. NUCLEAR REGULATORY COMMISSION VERIFICATION LETTER FOR ELECTRIC POWER RESEARCH INSTITUTE REPORT 3002013039, EPRI MOV PERFORMANCE PREDICTION PROGRAM: ADDENDUM 10 TO EPRI 103237 R2: PPM VERSION 4.0 SOFTWARE CHANGES (EPID: L-2019-TOP-0013)

Dear Mr. Riti:

By letter dated May 17, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19142A251), the Nuclear Energy Institute submitted for the U.S. Nuclear Regulatory Commission (NRC) staff review EPRI [Electric Power Research Institute] MOV [motor-operated valve] Performance Prediction Program: Addendum 10 to EPRI 103237-R2: PPM Version 4.0 Software Changes-A. Also attached to the May 17, 2019, letter was a May 6, 2019, letter providing a May 7, 2019, affidavit executed by Neil Wilmshurst, Vice President and Chief Nuclear Officer, EPRI. The affidavit requested that the information contained in the proprietary version of the EPRI 103237-R2 be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390.

A nonproprietary copy (ADAMS Accession No. ML19142A252) has been placed in the NRCs Public Document Room and added to the NRC Library in ADAMS.

The -A version of the topical reports, incorporate the NRC staffs letter accepting the Addendum 10 changes, the request for additional information (RAI) questions, and the RAI responses. Based on its review of the changes documented in the EPRI 103237-R2, the NRC staff has determined that the -A reports are acceptable to the extent delineated in the NRC staffs original letter, dated January 25, 2019 (ADAMS Accession No. ML18365A037).

With respect to the request for withholding the information in proprietary version of the report, EPRI detailed the reasons in its affidavit.

The NRC staff has reviewed the application and the material in accordance with the requirements of 10 CFR 2.390. Based on the statements in the affidavit, the NRC staff has determined that the submitted information contains proprietary, commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

T. Riti Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the agency may send copies of this information to its consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC staff.

You also should understand that the NRC staff may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
