Before the Board are four filings on behalf of eleven organizations and one person1 asserting representational standing or standing as of right based on residence in six different states: California, Illinois, Michigan, New Mexico, New York, and Texas. The applicant, Interim Storage Partners LLC, is based in Andrews, Texas.
The Board intends to conduct a pre-hearing conference in July to hear oral argument on standing and contention admissibility. Through the hospitality of the Lubbock County Commissioners Office, the Board has tentatively reserved a courtroom in the Lubbock County Courthouse in Lubbock, Texas for Thursday, July 11 and (if necessary) Friday, July 12, 2019.
However, the Board still solicits the views of the participants as to where to conduct oral 1 Beyond Nuclear, Inc.s Hearing Request and Petition to Intervene (Oct. 3, 2018); Petition of Permian Basin Land and Royalty Organization and Fasken Land and Minerals for Intervention and Request for Hearing (Oct. 29, 2018); Petition to Intervene and Request for Adjudicatory Hearing by Sierra Club (Nov. 13, 2018); Petition of Dont Waste Michigan, Citizens Environmental Coalition, Citizens for Alternatives to Chemical Contamination, Nuclear Energy Information Service, Public Citizen, Inc., San Luis Obispo Mothers for Peace, Sustainable Energy and Economic Development Coalition and Leona Morgan, Individually, to Intervene, and Request for an Adjudicatory Hearing (Nov. 13, 2018).
argument most efficiently. In addition to Lubbock, other possibilities (not necessarily limited to July 11-12) include the ASLBP Hearing Room at NRC headquarters in Rockville, Maryland (with the option of participation from other locations electronically) and perhaps elsewhere.
Accordingly, no later than May 20, 2019, any participant may, if it wishes, file and serve a brief statement of its position concerning the preferable location for oral argument on standing and contention admissibility. The Board does not expect that any such statement need be more than a page or two.
