Dear Mr. Segura:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the submittal dated December 20, 2018 (Agencywide Documents Access and Management System [ADAMS]
Accession Number ML18361A657), transmitted by Joseph J. Doncsecz.
This submittal is required to meet the requirements set forth in Condition S-3 of License SNM-
- 95.
We have completed our review of your submittal and concluded that Penn State University (PSU) has demonstrated that: (1) the financial condition meets the requirements of 10 CFR Part 30, Appendix E, and (2) the language of the Self Guarantee (SG) agreement, auditors opinion on PSUs audited financial statements, and previously submitted and approved Standby Trust Agreement are consistent with NRC guidance.
Therefore, the NRC staff finds that PSUs SG and supporting documentation are acceptable and are, therefore, approved.
Within 30 days after receipt of this letter, PSU should provide NRC with an updated Schedule A document.
Enterprise Project Identifier (EPID) L-2019-LNS-0000 is CLOSED.
In addition, NRC time and attendance records conclude that completing the review of your submittal was accomplished in approximately 25 staff hours.
In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
