STC-19-XXX UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 April 16, 2019 ALL AGREEMENT AND NON-AGREEMENT STATES STATE LIAISON OFFICERS NOTICE OF REQUEST FOR COMMENT: Harmonization of Transportation Safety Requirements with International Atomic Energy Agency (IAEA) Standards Rulemaking (STC-19-021)
Purpose:
To provide notification of the U.S. Nuclear Regulatory Commissions (NRCs) request in the Federal Register for public comment on the draft regulatory basis supporting the Harmonization of Transportation Safety Requirements with IAEA Standards rulemaking.
Background:
On April 12, 2019, the NRC published a Federal Register notice (FRN) requesting public comments on a draft regulatory basis to support a rulemaking that would harmonize the NRCs regulations with the safety requirements of the IAEA for the transport of radioactive material. This rulemaking would also maintain compatibility between the NRCs and the U.S. Department of Transportations regulations, and make other administrative, editorial, and clarifying revisions to improve implementation of the NRCs regulations in the Part 71 of title 10 of the Code of Federal Regulations (10 CFR), Packaging and Transportation of Radioactive Material.
The draft regulatory basis describes and documents the results of the assessments and analyses NRC performed to inform the proposed rulemaking action. The draft regulatory basis includes a main document and two appendices. Appendix A provides a summary of cost estimates and uncertainty analysis. Appendix B provides the detailed assessments of the regulatory issues the NRC identified, analyzed, and used to scope and provide justification for potential proposed revisions to 10 CFR Part 71.
Discussion: The FRN and draft regulatory basis document that support the Harmonization of Transportation Safety Requirements with IAEA Standards rulemaking are enclosed. The FRN is posted on the Federal e-rulemaking portal http://www.regulations.gov under Docket No.
NRC-2016-0179. The FRN can also be accessed at:

The draft regulatory basis is available in the NRCs Agencywide Documents Access and Management System under the accession number ML18262A185. The FRN provides details on how to submit comments, which are due by May 28, 2019. The NRC plans to hold a public meeting on April 30, 2019, to discuss the draft regulatory basis and facilitate public participation.
