MEMORANDUM AND ORDER (Denying Motion for Reconsidering Location of Oral Argument and Granting Motion to Webcast Oral Argument)

On March 6, 2019, Beyond Nuclear, Inc. (Beyond Nuclear) filed two concurrent motions:

(1) for this Licensing Board to reconsider its decision in setting this proceedings March 27, 2019 oral argument on the admissibility of contentions at the Atomic Safety and Licensing Board Panel (ASLBP) Hearing Room in Rockville, Maryland instead of near the Peach Bottom Atomic Power Station; and (2) alternatively, for this Board to webcast the oral argument from the ASLBP Hearing Room.1 In its filing, Beyond Nuclear represents that Exelon Generation Company, LLC (Exelon) does not support the motion for reconsideration but does not object to the argument being webcast from the ASLBP Hearing Room, and the NRC Staff does not object to either motion.2 The Board intends to conduct oral argument from the ASLBP Hearing Room as planned.

public transit from the offices of counsel for Beyond Nuclear and Exelon, and is publicly accessible for either in-person or listen-only telephone line attendance. For these reasons, the Board denies Beyond Nuclears motion for this Board to reconsider the oral arguments location.

However, given that Beyond Nuclears motion for the Board to webcast the oral argument is timely and there is no opposition from the other argument participants, the Board grants Beyond Nuclears motion for the Board to webcast the oral argument. Instructions on how the public can access the webcast will be issued in a subsequent notice by the Board.
