Proposed Defue/ed Technical Specifications and Revised License Conditions for Permanently Defueled Condition," dated July 25, 2018 (ML18206A545)

By letter dated July 25, 2018 (Reference 1), Exelon Generation Company, LLC (Exelon) submitted a License Amendment Request (LAR) to revise the Renewed Facility Operating License (RFOL) DPR-50 and Technical Specifications consistent with the permanent cessation of reactor operation and permanent defueling of the reactor for Three Mile Island Nuclear Station, Unit 1 (TMl-1).

The purpose of this letter is to withdraw Exelon's request to eliminate License Condition 2.c.(21) from the RFOL. The license condition was determined to preserve obligations to complete certain future activities related to license renewal that would be applicable in decommissioning, particularly item 43, Boral and Metamic Test Coupon Surveillance. The Attachment to this letter provides a revised markup of the TMl-1 RFOL page to reflect this change. This revised page supersedes the associated page in Reference 1.

Exelon has reviewed the information supporting a finding of No Significant Hazards Consideration and the Environmental Consideration provided to the NRC in Reference 1. The additional information provided in this submittal does not affect the previously stated bases in Reference 1 for concluding that the proposed license amendment does not involve a significant hazards consideration. In addition, the information provided in this submittal does not affect the bases for concluding that neither an environmental impact statement nor an environmental assessment needs to be prepared in connection with the proposed amendment.

(19) DELETEDAt tho time of tho closing of tho transfer of TM1 1, and tho rospocti 110 license from AmorGon Energy Company, LLC (AmorGon) to Exelon Generation Company, AmorGon shall transfer to Exelon Generation Company ownership and control of AmorGon TMI NQF, LLC, and AmorGon Consolidation, LLC shall be merged into Exelon Generation Consolidation, LLC. Also at tho time of tho closing, decommissioning funding assurance provided by Exelon Generation Company, using an additional method allowed under 10 CFR 50.75 if necessary, must be equal to or greater than tho minimum amount calculated on that date pursuant to, and required by 10 CFR 50.75 for TMI 1. Furthermore, funds dedicated tor TMI 1 prior to closing shall remain dedicated to TMI 1 follo¥.*ing tho closing. Tho name of AmorGon TMI NQF, LLC shall be changed to Exelon Generation TMI NQF, LLC at tho time of tho closing.

{20) DELETEDTho information in tho UFSAR supplement, as revised, submitted pursuant to 10 CFR 54.21 (d), shall be incorporated into tho UFSAR no later than tho next scheduled update required by 10 CFR 50.71 (o) following tho issuance of this renewed operating license. Until this update is complete, Exelon Generation Company may not make changes to tho information in tho supplement. Following incorporation into tho UFSAR, tho need for prior Commission approval of any changes 'Nill be governed by 10 CFR 50.59.

{21) The UFSAR supplement, as revised, submitted pursuant to 10 CFR 54.21 {d),

describes certain future activities to be completed prior to and/or during the period of extended operation. The licensee shall complete these activities in accordance with Appendix A of NUREG-1928, "Safety Evaluation Report Related to the License Renewal of Three Mile Island, Unit 1," dated, October, 2009. The licensee shall notify the NRC in writing when activities to be completed prior to the period of extended operation are complete and can be verified by NRC inspection.

{22) Handling of irradiated fuel in the Spent Fuel Pool will not be permitted following implementation of the POTS until a minimum of 60 days following the permanent shutdown.

d. This license is effective as of the date of issuance and shall expire at midnight, April 1Q, 2034 is effective until the Commission notifies the licensee in writing that the license is terminated.
