AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS OVERSIGHT OF THE NATIONAL MATERIALS PROGRAM (OIG-18-A-11)

REFERENCE:

STATUS OF RECOMMENDATIONS: ACTING DIRECTOR FOR OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS MEMORANDUM DATED FEBRUARY 15, 2019 Attached is the Office of the Inspector Generals (OIG) analysis and status of recommendations as discussed in the agencys response dated February 15, 2019.

Based on this response, recommendations 1 and 2 are resolved. Please provide an updated status of the resolved recommendations by July 15, 2019.

Status of Recommendations Recommendation 1: Formalize the National Materials Program framework in a document to include a definition, vision, mission, goals and objectives, membership, members roles and responsibilities, and activities.

Agency Response Dated February 15, 2019:

Current Status The following actions were taken by staff:

1. Developed a draft NMP (National Materials Program) guidance document that identifies a definition, vision, mission, goals and objectives, membership, members roles and responsibilities, and activities of the NMP.
2. Participated in a panel discussion on August 13, 2018, at the annual meeting of the Organization of Agreement States (OAS) that included presentation of the concepts of the NMP to include in the guidance document and obtained feedback from the Agreement States.
3. Issued the draft National Materials Program guidance document, designated as Office of Nuclear Material Safety and Safeguards (NMSS) State Agreement (SA)

Procedure SA-10, Oversight of the National Materials Program, on January 22, 2019, to the NRC Regional Offices and the Agreement States for a 45-day comment period. During the comment period, the staff will conduct webinars on February 7 and 20, 2019, to discuss the draft procedure and solicit feedback.

Status of Recommendations Recommendation 1 (cont.):

Next Steps

1. NMSS management will be attending the OAS Board meeting on March 14, 2019, to discuss the guidance document and its implementation, and seek feedback.
2. Upon completion of the comment period, the staff will compile all Agreement State and NRC Regional comments, prepare comment resolution documents, and make changes to the procedure as needed.
3. The procedure and comment resolution documents will be reviewed and approved by management.
4. The staff will distribute the approved procedure to the Agreement States and NRC Regional Offices.

Target Completion Date: May 2019.

OIG Analysis: The proposed actions meet the intent of the recommendation. OIG will close the recommendation after verifying that NRC has developed and issued the document that includes a definition, vision, mission, goals and objectives, membership, members roles and responsibilities, and activities.

Status: Resolved.

Audit Report AUDIT OF U.S. NUCLEAR REGULATORY COMMISSIONS OVERSIGHT OF THE NATIONAL MATERIALS PROGRAM (OIG-18-A-11)

Status of Recommendations Recommendation 2: Designate an NRC individual with expert knowledge to serve as the National Materials Program champion to help with consistent communication. NRC should encourage the Agreement States to create a co-champion to serve as the NRC champions peer.

Agency Response Dated February 15, 2019:

Current Status The following actions were taken by staff:

1. The Director of the Division of Material Safety, Security, State and Tribal Programs (MSST) has been designated the NMP Champion in the draft procedure currently out for comment.
2. The draft procedure also includes the role of an NMP co-champion. The OAS has indicated that they plan to name an NMP co-champion.

Next Steps When the procedure is issued as final, the Director of MSST will become the NMP Champion.

Target Completion Date: May 2019.
