Dear Ms. Steves:
On September 18, 2018, the Management Review Board (MRB) met to discuss the Integrated Materials Performance Evaluation Program (IMPEP) review of the Kansas Agreement State Program (Kansas Program). The MRB found the Kansas Program adequate to protect public health and safety, but needs improvement, and compatible with the U.S Nuclear Regulatory Commissions (NRC) program. Because of the significance of the findings, the MRB determined that the Kansas Program should enter a period of Heightened Oversight.
Heightened Oversight is an increased monitoring process the NRC uses to follow the progress of improvement needed in an Agreement State program. It involves preparation of a Program Improvement Plan (PIP), bi-monthly conference calls, and submission of status reports prior to each bi-monthly call with the Kansas Program and NRC managers and staff members. In our October 18, 2018, letter transmitting the final IMPEP report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18267A223), the NRC requested the Kansas Program submit a PIP for review within 30 days.
The NRC has reviewed the PIP you submitted on November 15, 2018 (ADAMS Accession No. ML18324A616), and the updated PIP submitted on January 18, 2019 (ADAMS Accession No. ML19036A701). The PIP for the Kansas Program specifies the actions developed to address a broad range of inspection, licensing, incident response, and compatibility issues identified during the Kansas Programs 2018 IMPEP review. Based on the information provided in the PIP and during the Heightened Oversight call on January 28, 2019, the NRC has determined that the PIP adequately addresses each of the outstanding issues, provides estimated completion dates, and specifies responsibilities. As a result of our review, the NRC has approved the updated PIP submitted on January 18, 2019.
As part of the Heightened Oversight process, there will be bi-monthly telephone calls between the Kansas Program and the NRC. Please submit an updated version of the PIP to the Regional State Agreements Officer at least five days in advance of the call.
