AMENDMENT NOS. 7 AND 8 TO CERTIFICATE OF COMPLIANCE NO. 1025 FOR THE NAC-MULTI PURPOSE CANISTER STORAGE SYSTEM

Dear Mr. Fowler:

As requested by your applications dated November 14, 2017 (see Agencywide Documents Access and Management System (ADAMS) Accession No. ML17326A128), and February 28, 2018 (ADAMS Accession No. ML18059A784), as supplemented on February 12, 2018 (see ADAMS Accession No. ML18045A440), enclosed is Amendment Nos. 7 and 8 to the Certificate of Compliance (CoC) No. 1025 for the NAC-Multi Purpose Canister (MPC) storage system.

These amendments, issued by the U.S. Nuclear Regulatory Commission (NRC) constitutes the approval and conditions for use of the MAGNASTOR storage system for storage of spent nuclear fuel under the general license provisions of 10 CFR Part 72, Subparts K and L.

Amendment No. 7 revises the NAC-MPC CoC to change the definition for OPERABLE under Technical Specification (TS) A 1.1, Definitions to delete reference to the Multi Purpose Canister for the La Crosse Boiling Water Reactor, revise TS A 3.1.6, and revise TS A 5.3 under A 5.0, ADMINISTRATIVE CONTROLS AND PROGRAMS to delete the requirement for a response surveillance following off normal, accident or natural phenomena events since it is covered by existing LCO SRs and frequencies.

Amendment No. 8 revises the NAC-MPC CoC to revise both TS A 3.1.6, and TS A 3.2.2, and delete TS No. A 5.3.

As stated in the Federal Register (83 FR 64729, December 18, 2018), the effective date of these CoCs is March 4, 2019. The NRC safety evaluation reports (SER) for these amended CoCs (including the Technical Specifications) are enclosed.
