Dear Mr. Miller:
We are writing you in behalf of our client, Public Service Electric and Gas Company, and are presenting you herewith a check.. in the amount of two hundred fifty-six
- thousand, on~ hundred and five dollars ($256,105.00) as payment of the presently prescribed fee for the low power (1%)
operatin~ license for Salem Unit 1 to be issued this date.
Public Service pays this amount under protest in light of the pending rulemaking proceedings which con-cern revisions to the Co:m:tnission's license fee schedule to comport with applicable law, including the Supreme Court decisions in National Cable Television Association
- v. United States, 415 U.S.. 336 (1974) and Federal Power Commission v. New England Power Company, 415 U.S. 345 (1974) ~
In essence, we are of the view that the amount presently required by.your agency for the low power (1%) operating license exceeds the amount properly due and owing.
