Dear Mr. Miller:
We are writing you in behalf of our client, Public Service Electric and Gas Company, and are presenting you herewith a check in the amount of six hundred eleven thousand, four hundred twenty-five dollars ($611,425.00) as payment of the presently prescribed fee for the full power operating license for Salem Unit 1.
Public Service pays this amount under protest in light of the pending rulemaking proceedings which concern revisions to the Commission's license fee schedule to comport with appli-cable law, including the Supreme Court decisions in National Cable Television Association v. United States, 415 U.S. 336 (1974) and Federal Power Commission v.
New England Power Company, 415 U.S. 345 (1974).
In essence, we are of the view that the amount presently required by your agency for the full power operating license exceeds the amount properly due and owing.
