- We are writing you in behalf of our client, Public Service Electric and Gas Company, and are presenting you
- herewith a check **in the amount of two hundred fifty-six thousand, one hundred and five dollars ($256,105.00) as payment of the presently prescribed fee for the low power (1%) operating license for Salem Unit 1 to be issued this date.
Public Service pays this amount under protest in light of the pending rulemaking proceedings which con-cern revisions to the Commission's license fee schedule to comport with applicable law, including the Supreme Court decisions in National Cable Television Association
- v. United States, 415 U.S. 336 (1974) and Federal Power Commission v. New England Power Company, 415 U.S. 345 (1974).
In essence, we are of the view that the amount presently required by your agency for the *1ow power (1%) operating license exceeds the amount properly due and owing.
