LICENSEE'S ANSWER TO NOTICE OF HEARING Docket No. 50-272 (Proposed Issuance of Amendment to Facility Operating License No. DPR-70)
Public Service.Electric and Gas Company, Licensee, for itself and on behalf of Philadelphia Electric Company, Del-marva Power and Light, and Atlantic City Electric Company, hereby acknowledges receipt of the "Notice of Hearing on Amendment of Facility Operating License" issued in this proceeding, dated April 26, 1978, and published in. the Federal Register on May 2, 1978 (43 Fed. Reg. 18803).
The Licensee has requested the issuance of an amendment to Facility Ope*rating License No. DPR-70,. which would revise the provisions in the Technical Specifications to permit an increase in fuel storage capacity from 264 to 1170 fuel assemblies in the spent fuel pool, and would revise design features and associated operating limits for the storage pool, as.necessary, to accommodate the increased storage.

.., In support of the issuance of-such amendment, the Licensee will appear at the hearing and present evidence in support of the following findings:
(1)
There is reasonable assurance that the health and safety of the public wili not be endangered by operation in the proposed manner.
(2)
Such activities will be conducted in compliance with the Commission's regulations and the issuance of this amendment will not be inimical to the *.
common defense and security, or to the health and safety of the public.
(3)
With regard to the requirements set forth in 10 C.F.R. Part 51 and the Council of Environmental Quality's Guidelines,. 40 C.F.R. §1500.6, and applying, weighing, and balancing the five factors specified by the Commission in 40 Fed~ Reg. 42801, the proposed license amendment will not signif i-
~antly affect the quality of the human environment.
