I am the attorney for Intervenors, Alfred and Eleanor Coleman, in the within proceeding before the Atomic Safety and Licensing Board, Docket No. 50-272, constituted by the Nuclear Regulatory Commission to adjudicate the several challenges to the application by Public Service Electric and Gas Company to expand the on-site storage of spent radioactive fuel at its Salem One Nuclear Generating Station.
- 2.
By Order Docketed February 26, 1979, the Board has directed that the pre-hearing conference in this matter be held at 1:30 p.m., Thursday, March 15, 1979 and a separate special prehearing conference, with b\\O sessions--
7 p.rn. Thursday, I>1arch 15, 1979 and 9:30 a.rn. Friday, March 16, 1979--to receive both written and oral statements by persons who wish to make limited appearances.

In order to ensure that the Prehearing Order 1<lhich is is sued at the conclusion of this conference properly reflects significant, material issues, contentions and or otherwise pertinent facts proffered by persons making limited appearances during the two sessions which are scheduled to be held after the single prehearing conference Thursday afternoon, it is necessary that all three sessions on.March 15 and March 16, 1979 be deemed part of the prehe.:iring conference for purposes of detenninations properly within the scope of said order.

The Prehearing Conference Order will establish the scope and pararnete:
of the hearing to be held in this matter.
TI1erefore, in order for the state-ments and the Kritten submissions by persons making limited appearaI1ces to
be acted upon by the Board in a meaningful man.rier it is necessary that their inclusion in the Prehearing Order not be foreclosed by the present conference schedule.

On January 2, 1979, I began my employment with the Ne\\.; Jersey Department of the Public Advocate, Division of Public Interest Advocacy as an.Assistant Deputy Public Advocate.
- 2.
Since starting this employment, I have been given primary responsibility for several major matters presently in litigation or being prepared for adjudicatory proceedings before both State and federal adrninist:::-ative agencies.
- 3. Tilese matters include.American Dredging Company v. State of New Jersey, Department of Environmental Protection, Docket No. 372-78, New JeTsey Superior Court, Appellate Division participation as amicus curiae ll1 appeal challenging constitutionality of New Jersey Wetlands Act as applied to appellant's property; Morris County Fair Housing Council, et al. v. Boonton Township, et al., Docket No. L-6001-78 P.W., New Jersey Superior Court, Law Division, representation of plaintiffs in trial court action to have the zoning ordinances of twenty-seven municipalities declared unconstitional for failure to provide least cost housing opportunities; In re Application of Jersey Central Power & Light Co., etc., Docket No. 771-60, New Jersey Department of Energy, Board of ~ublic Utilities, Docket No. 771-60, represen-tation of public in proceeding before B.P.U. to have its zoning override approval for constn1ction of transmission lines reconsidered.

IUso, on FebTUary 6, 1979, I assLUTied the primary responsibility for representing Intervenors, Alfred and Eleanor Coleman, in the within proceeding before the Nuclear Regulatory Commission to contest the application
by Public Service Electric and Gas Company for an amendment of its i\\TRC license to operate the Salem One \\uclear Generating Station with gTeatly expanded on-site storage of spent radioactive fuel.
- 5.
On Febniary 28, 1979 Intervenors were served with the licensee's motion for Slil11l11ary disposition of the Colemans' contentions Two, Six, Nine and Thirteen.
This motion, supported by multiple, voluminous affidavits, undoubtedly required preparation over an extended period of time.
Licensee has had over eight months to devote to this task, since these contentions were admitted at the initial ASIB conference held in May 6, 1978.
- 6.
Pursuant to rule 10 C.F.R. §2.749 Colemans' response presently should be filed no later than March 19, 1979.
This very short deadline does not in my opinion afford the Colemans a fair and reasonable amount of time to adequately prepare the necessary detailed and verified response to licensee's motion.
- 7.
Therefore, the Colernans hereby request an extension of time to file their response to the Public Service Motion for Summary Disposition until ancl including April 19, 1979.
- 8.
Counsel for licensee, Mr. Fryling stated to me during a phone conversation on March 6, 1979 that he would neither consent nor object to a 15 day extension on Intenrenor's deadline for a response to the within motion.
