By letter dated January 2, 2019 (Agencywide Documents Access Management System (ADAMS) Accession No. ML18337A418), the U.S. Nuclear Regulatory Commission (NRC) staff provided a copy of a Notice of Consideration of Approval of Direct and Indirect Transfers of Renewed Facility Operating License and Conforming Amendment, and Opportunity for a Hearing related to the Pilgrim license transfer application dated November 16, 2018 (ADAMS Accession No. ML18320A031, as supplemented by letter dated November 16, 2018 (ADAMS Accession No. ML18320A030) filed by the Applicants. The Applicants are Entergy Nuclear Operations, Inc., on behalf of itself and Entergy Nuclear Generation Company (to be known as Holtec Pilgrim, LLC), Holtec International, and Holtec Decommissioning International, LLC.
I want to clarify the letter, dated January 2, 2019. On January 2, 2019, I digitally signed the Federal Register notice; however, due to the partial federal government shutdown, the Office of the Federal Register (OFR) is required to publish documents directly related to the performance of governmental functions necessary to address imminent threats to the safety of human life or protection of property. The Pilgrim license transfer application is not an imminent threat to the safety of human life or protection of property.
Therefore, the Pilgrim license transfer application will not be published in the Federal Register until the partial federal government shutdown ends. After the partial government shutdown ends and the Pilgrim license transfer applications gets published in the Federal Register, the 20-day hearing period and the 30-day comment period will be based on the actual publication date in the Federal Register.
