Dear Licensing Board:

On behalf of Holtec International, Beyond Nuclear, Fasken Lands and Minerals and Permian Basin Land and Royalty Owners, the NRC Staff, and NAC International, we write to request that the Atomic Safety and Licensing Board panel address two matters. First, an article this morning in a Bloomberg electronic news service reported that it would be up to individual federal courthouses and judges to decide which employees would be asked to stay home as a result of the government shutdown. A December 22, 2018 press release from the United States Courts indicated that after January 11, 2019, the federal court system would allow work to continue "if it is necessary to support the exercise of A1iicle III judicial powers." In view of the need to plan for the January 23-24, 2019 oral argument, we would respectfully ask whether the Board has received any information as to the availability www.pillsburylaw.com 485 l-0233-6133.v4

January 7, 2019 Page2 of the Albuquerque federal courthouse in the event that the government shutdown continues. Second, we would also ask the Board when we might receive the additional guidance on the topics for and the structure of the oral argument (including the anticipated schedule of items to be argued), as indicated in the Board's December 14, 2018 Order.

We have informed the other parties that we were intending to submit this letter and Beyond Nuclear, Fasken Lands and Minerals and Permian Basin Land and Royalty Owners, the NRC Staff, and NAC International requested to join the letter. Sierra Club and Don't Waste Michigan, et al., have no objection to the letter. We have not heard from the Alliance for Environmental Strategies by the time of filing.
