As I mentioned yesterday on the phone and in my voice message I just left on your phone, John Heaton is trying to arrange for live streaming of the oral arguments so that the stakeholders in Southeast NM are able to observe. After multiple calls and call backs from the Court Administrator, John learned that the court is dealing with Twana Ellis at the NRC who is in charge of logistics. It is the policy in the Court House that there are no cameras and recording devices allowed. However, since this is not a case for the court and basically an outside hearing, those with whom John has spoken seem to think these policies would not apply. Diana Zanbrano ( - ) at the Court gave John Twanas number. John has spoken with Twana Ellis who informed him he must write a letter to Mr. Joseph McManus. Please see the attached e-mail message that John wrote to Mr. McManus.

We and the citizens of area are the parties that have a significant interest in anything that affects the Holtec Consolidated Interim Storage Facility. We all have a significant amount of blood, sweat, tears, time, capital investment and a strong interest in the economic development this project brings to our area.

Frankly, we were confused at the choice of venue for the hearing to be Albuquerque. Albuquerque is over 300 miles from the site and the people that are directly affected by the project.

Both of the cities of Carlsbad and Hobbs have agreed to make their citys municipal chambers available for live streaming of the hearings to enable our citizens to observe the proceedings. I think we all understand live steaming today is a very simple, straight forward, widely used communication avenue.

I realize the ASLB has provided notice that there would be no live streaming based on the policy restrictions of the court to not allow video, audio, streaming or cameras for their case hearings.

However, upon speaking to Diana Zanbrano of the court, she has advised me that since the ASLB hearing is NOT a case hearing of the court that the Chief Judge and Chief Clerk could possibly allow live streaming of the ASLB hearing. She advises me that the request for live streaming would need to come directly from the ASLB to the court for them to consider the request.

Therefore, we would respectfully request that you request of the court in Albuquerque to allow live streaming of the ASLB hearing to the city hall chambers of the cities of Carlsbad and Hobbs for the purpose of allowing the directly affected public in the area of the project, who are 300 miles from Albuquerque, to observe and hear the arguments presented in the ASLB hearing.

Dear Administrative Judges:

The City of Carlsbad respectfully requests that the Atomic Safety and Licensing Board ("Board") make arrangements that will allow the City of Carlsbad to livestream the oral argument on standing and contention admissibility in Albuquerque, New Mexico on January 2324, 2019.

Albuquerque, NM is over 250 miles away from the City and the Holtec site, which is a driving distance of four to five hours. As a result, few, if any, of our interested constituents will be able to attend the oral argument. Holding the oral argument so far from our community, which is less than 35 miles from the Holtec site, does a disservice to those members of our community who are interested in the Holtec facility.

COUNCILORS December 13, 2018 Page2 In light of the Board's decision to hold the oral argument in Albuquerque, the City of Carlsbad requests that the Board make the necessary arrangements to broadcast the oral arguments such that the City of Carlsbad can livestream the proceedings in its City Hall meeting room. The City Hall meeting room can accommodate up to 150 (with overflow space available) who would be able to watch the proceedings.

While holding the hearing locally would have been preferable, a livestream will at least enable our community to be involved in the hearing process Our IT professional, Sam Plumlee, is prepared to answer any questions that the Board may have on the arrangements necessary to establish a livestream at our City Hall meeting room.
