RECOMMENDATIONS TO IMPROVE THE NON-CONCURRENCE PROCESS AND DIFFERING PROFESSIONAL OPINION PROGRAM RESULTING FROM THE DIFFERING VIEWS PROGRAM IMPROVEMENT PROJECT This memorandum transmits the recommendations to improve the effectiveness and efficiency of the non-concurrence process (NCP) and differing professional opinion (DPO) program resulting from the differing views program (DVP) improvement project. The list of recommendations and a basis for each is included in the enclosure to this memorandum. To better serve its stakeholders, the U.S. Nuclear Regulatory Commission (NRC) Office of Enforcement (OE) initiated the DVP improvement project in March 2018.

The project began by achieving up-front clarity and alignment with project participants on the project parameters. Next, the project participants reviewed relevant documents, including recent assessments, surveys, and audits, to compile process-related concerns and suggestions to address those concerns. The set of concerns and suggestions was augmented by interviews with internal and external stakeholders, written comments from NRC management and staff, and benchmarking studies of other organizations. The project lead studied and systematically processed the set of over 600 concerns and suggestions to develop draft recommendations specifically crafted to eliminate, or significantly reduce, the most important and most commonly cited concerns. The recommendations were reviewed by OE Concerns Resolution Branch management and staff, OE safety culture and federal employee viewpoint survey subject matter experts, the Office of the Chief Human Capital Officer (OCHCO) lead for NRC Safety Culture and the Open Door Policy, the NRC allegations advisor, and OE office director and deputy.

After incorporating their feedback, the recommendations were shared in a brief to the Office of the Executive Director for Operations (OEDO) and to NRC office directors and regional administrators at an Agency Mission Meeting.

The final recommendations to improve DVP effectiveness and efficiency contain seven transformative recommendations and 13 recommendations related to change management, minor process changes, and process documentation updates.

As you are familiar with the offered recommendations, unless we hear otherwise, OE will proceed to communicate the DVP improvement project results to the Union and more broadly beginning with an agency communication on or about January 14, 2019. OE will also work and track implementation of the recommendations throughout calendar year 2019 and 2020. We will re-engage with the OEDO as needed on significant program or resources issues (e.g.,

ombudsman program). We are available to address any comments or questions related to the recommendations, and to provide any other assistance as needed.
