REQUEST FOR CONCURRENCE ON DETERMINATION OF NO HISTORIC PROPERTIES AFFECTED REGARDING THE LACROSSE BOILING WATER REACTOR LICENSE TERMINATION PLAN (DOCKET NUMBER: 50-409)

Dear Mr. Draeger:

The U.S. Nuclear Regulatory Commission (NRC) staff is reviewing a license amendment request from LaCrosse Solutions, LLC (Solutions) related to the LaCrosse Boiling Water Reactor (LACBWR). Solutions is requesting NRCs approval of its License Termination Plan (LTP) for LACBWR. The LTP was submitted as part of the license amendment request in June 2016 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML16200A095) and updated in May 2018 (ADAMS ML18169A235). The LTP describes the process Solutions will use to meet the NRC requirements for terminating the operating license and to release the site for unrestricted use.

By letter dated June 25, 2018, the NRC staff provided notification and request for consultation with the Wisconsin Historical Society regarding the LACBWR LTP (ADAMS ML17067A442).

In March 2017, the NRC requested input from the Ho-Chunk Nation, the only Federally-recognized Tribe located within 50 miles of the LACBWR (ADAMS ML17053A162). The NRC staff has not received any input to date from the Tribe in response. In June 2018, the NRC sent letters to an additional 13 Tribes with historic ties to the area (ADAMS ML18159A312). The Miami Tribe of Oklahoma responded to our letter and indicated that they were not currently aware of existing documentation directly linking a specific Miami cultural or historic site to the project site. (ADAMS ML18198A055).

Based on our review of previous environmental reviews, information submitted by the licensee, and outreach to the 14 Tribes, the NRC staff has determined that there are no historic properties at LACBWR. Further, any land disturbing activities would occur on previously disturbed land within the site boundary. The NRC is therefore requesting your offices concurrence on the NRCs No Historic Properties Affected determination. This letter conveys the completed Request for State Historic Preservation Office Comment and Consultation on a Federal Undertaking Form (Enclosure 1) and the draft Environmental Assessment (EA)

(Enclosure 2) supporting the NRCs determination that No Historic Properties Affected for your agencys review and concurrence. The draft EA is non-public.

Documents transmitted herewith contain Sensitive-Internal Information. When separated from the sensitive conditions in the enclosure, this document is decontrolled.
