Dear Mr. Miranda,
In your email dated November 23, 2018 to Mr. Jorge Corujo-Sandin, you requested Region 3 review the licensing bases for the pressurizer safety valves during the upcoming Design Bases Assurance Inspection at the Braidwood Nuclear Generating Station. The Design Bases Assurance Inspection samples are selected and the inspection is performed in accordance with NRC Inspection Procedure 71111.21M. A copy of this procedure can be obtained through our ADAMS Public Documents portal https://www.nrc.gov/reading-rm/adams.html and searching for accession number ML16340B000 or through our inspection procedures public webpage here https://www.nrc.gov/docs/ML1634/ML16340B000.pdf. The Braidwood Design Basis Assurance Inspection results will be documented in Inspection Report 05000456/2019010; 05000457/2019010, which publicly available within 45 days of completing the inspection.
We discussed the information provided in your email with our counterparts in the NRCs Office of Nuclear Reactor Regulation and representatives within the Office of the Executive Director (EDO).
Through these discussions, we became aware of your email to the EDO dated August 28, 2018 requesting the NRC revisit the Exelon backfit appeal for Braidwood regarding the pressurizer safety valves. The EDO responded to your email on October 17, 2018 stating the NRC stood behind the decision made by our Backfit Appeal Review Panel. During this review, the Panel also identified that the licensing basis for Byron and Braidwood complies with the applicable regulations and provides adequate protection of public health and safety. As stated in the EDOs email response to you, the regulations in Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206 provide a means for individuals to request that the NRC institute a proceeding to modify, suspend, or revoke a license, or for other appropriate action. This is the appropriate process for resolving any outstanding safety or compliance concerns you may have regarding the issues addressed in the Exelon backfit.
