December 6, 2018 EN 18-015 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Exelon Generation Company, LLC EA-18-107 Peach Bottom Atomic Power Station Docket No.: 50-277 and 50-278

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION A Notice of Violation (NOV) will be issued on or about December 11, 2018, to Exelon Generation Company, LLC (Exelon), for a violation associated with a White Significance Determination Process finding identified during an inspection at Peach Bottom Atomic Power Station (Peach Bottom.) The White finding, an issue of low to moderate safety significance, involved a failure by Exelons staff at Peach Bottom to establish measures to assure that conditions adverse to quality associated with the E-3 Emergency Diesel Generator scavenging air check valve were promptly identified and corrected. Specifically, this failure resulted in significant mechanical failure of the E-3 EDG on June 13, 2018. This finding is a violation of Title 10 of the Code of Federal Regulations Part 50, Appendix B, Criterion XVI, Corrective Action, and also caused a violation of Technical Specification 3.8.1, Electrical Power Systems

In accordance with the NRC Enforcement Policy, this NOV is considered an escalated enforcement action because it is associated with a White finding. Additionally, the licensees performance at Peach Bottom placed the facility in the Regulatory Response column of the NRCs Reactor Oversight Process Action Matrix, effective the third quarter of 2018.
On November 13, 2018, the NRC issued a preliminary determination letter for this issue and offered the licensee the opportunity to attend a Regulatory Conference or respond in writing. In a phone call on November 19, 2018, Exelon responded that they did not intend to respond to the preliminary determination letter.
The licensee has not yet been specifically informed of the enforcement action. The schedule of issuance and notification is:
