Dear Sir/Madam:

In accordance with N.J.A.C. 7:1 E-5.8, PSEG Nuclear LLC (PSEG) is submitting the enclosed discharge confirmation report. This report describes the initial call made to the hotline of a "sheen" observed in an excavation being undertaken in the switchyard.

The discharge was reported to the New Jersey Department of Environmental Protection (NJDEP) hotline and also to the Nuclear Regulatory Commission (NRC) pursuant to that agency's requirements.

The enclosed report contains information known at the time and updated with i1"1formation to support the final determination that this was not a discharge. Since there was no discharge, the spill was not reportable and therefore PSEG Nuclear is retracting the report and is requesting a rescission of the report by the DEP.

GUARANTEE Guarantee made this April J5, 2018 by PSEG Power LLC, a business entity organized under the laws of the State of Delaware, herein referred to as Guarantor, to the New Jersey Department of Environmental Protection ("Department") and to any and all third parties, and obiigees, on behalf of its wl10lly owned operating subsidiaries~ PSEG Fossil 1:,LC, which operates the Bergen, Burlington~ Essex, Kearny, Linden, and Sewaren Generating Stations andPSEG Nuclear LLC, which operates Hope Creek and Salem Generating Stations, of80 Park Plaza, Newark, New Jersey 07101.

(1) Guarantor meets or exceeds the financial test criteria ofN.J.A.C. 7:1E-4.4(g) and agrees ,

to comply with the requirements for guarantors as specified in N .J.A.C. 7:1E~4.4(h).

This guarantee satisfies the requirements ofN.J.A.C. 7:lE-4.4 for assuring funding in the amount of $1,000,000 per occummce per facility and $2,000,000 annual aggregate per facility for cleanup and removal activities arising from operating the above identified major facilities.

(3) On behalf of our wholly owned operating subsidiaries> PSEG Fossil LLC and PSEG Nuclear LLC, Guarantor guarantees to the Department and to any and all third parties that:

In the event that PSBG Fossil LLC or PSEG Nuclear LLC fails to provide alternate coverage within 60 days.after receipt ofa notice of cancellation of this guarantee and the Department hasdete1mined or suspects that a discharge has occmn:d at a facility covered by this guarantee, the Guarantor, upon instructions from the Department, shall fund a standby trust fund in an amount sufficient to cover cleanup and removal costs, but not to exceed the coverage limits specified in N.J.A.C: 7:1E-4.4(b).

In the event that the Department determines that PSEG Fossil ILC or PSEG Nuclear LLC has failed to perform cleanup and removal activities arising out of the operation of the above-identified facilities, the Guarantor, upon written instructions from the Department shall fund a standby trust in an amount sufficient to cover cleanup and removal costs, but not to exceed the coverage lifnits specified above.

(4) Guarantor agrees that if, at the end of any fiscal year before cancellation of this guarantee, the Guarantor fails to meet the financial test criteria ofN.J.A.C. 7: 1E-4.4(g),

Guarantor shall send within 120 days of such failure, by certified mail, notice to PSBG Fossil LLC and PSEG Nuclear LLC and the Department. The guarantee will terminate 120 days from the date ofrecerpt of the notice by PSEG Fossil LLC and PSBG Nuclear LLC or 120 days from the date of receipt of the notice by the Department, whichever is later, as evidenced by the return receipt.

(5) Guarantor agrees to notify PSEG Fossil LLC and PSEG ~uclear LLC by certified mail of a voluntary or involuntary proceeding under Title 11 (Bankruptcy), U.S. Code, naming Guarantor as debtor, within 10 days after commencement of the proceeding.

(6) Guarantor agrees to remain bound under this guarantee notwithstanding any modification or alteration of any obligation of PSEG Fossil LLC or PSEG Nuclear LLC, pursuant to N.J.A.C. 7:lE.

(7) Guarantor agrees to remain bound under this guarantee for so long as PSEG Fossil LLC or PSEG Nuclear LLC must comply with the applicable financial responsibility requirements of N.J.A.C. 7: lE-4.4 for the aboye-identified facilitiest except that Guarantor may cancel this guarantee by sending notice by certified mail to PSEG Fossil LLC and PSEG Nuclear LLC, and the Department, such cancellation to become effective no earlier than 120 days after receipt of such notice by PSEG Fossil LLC and PSEG Nuclear LLC, or 120 days from the date of receipt of the notice by the Department, whichever is later, as evidenced by the retmn receipt (8) The Guarantor's obligation does not apply to any of the following:

(c) . Bodily injury or property damage not related to a discharge arising from the ownership, maintenance, use, or entrustment to others of any aircraft, motor vehicle, or watercraft; (d)

  • Property damage to any property owned, rented, loaned to, in the care, custody, or control of, or occupied by PSEG Fossil LLC or PSEG Nuclear LLC that is not the direct result of a discharge from, the facility; (e) Bodily damage or property damage for which PSEG Fossil LLC or PSEG
  • Nuclear LLC is obligated to pay damages by reason of the assumption of liability in a contract or agreement other than a contract or agreement entered into to meet the requirements ofN.J.A.C. 7:lE-4.4.

Bureau of Discharge Prevention - Discharge Confirmation Report LR-E18- 0126 The below information summarizes the field observations, evaluation of potential sources, sampling results, and recommendations associated with the sheen that was observed in the Salem Switch Yard.

On October 25, 2018, PSEG Nuclear mobilized our remediation Contractor following the notification of a potential sheen observed on groundwater that accumulated within two trenches in the Salem Switch Yard. The Contractor mobilized a scientist to collect samples and record general observations. The Contractor was directed to two trenches on the northern side of the Salem Switch Yard. Measurements indicated that the bottom of each trench was approximately 36 inches below ground surface (bgs) and water was at approximately 30 inches bgs.

One sample was collected from the water that accumulated in each of the trenches (total of two samples). Samples were submitted to SGS Accutest under full chain of custody procedures.

On October 26, 2018, PSEG identified two potential sources of the sheen, dielectric fluid or Yellow 77 Wire Pulling Lubricant. The remediation Contractor reviewed the Safety Data Sheet for the lubricant and determined that the ingredients were aliphatic hydrocarbons. Aliphatic hydrocarbons are detectable using the Extractable Petroleum Hydrocarbon (EPH) analysis. As such, in accordance with the N.J.A.C. 7:26E-2.1 (d)1 and Table 2-1 (Technical Requirements for Site Remediation) samples were analyzed for EPH and polychlorinated biphenyls (PCBs).

On November 7, 2018, preliminary analytical results from the groundwater samples were provided by the laboratory. Analytical results indicated that EPH and PCBs were not detected in either of the groundwater samples. Final confirmatory lab sample results also confirmed them as non-detect. Accordingly, no constituents exceed the NJDEP's Groundwater Remediation Standards. Further, observations by PSEG Nuclear indicated that the sheen was no longer present in the trenches.

Based on a comparison of analytical results to the NJDEP's Groundwater Remediation Standards, EPH was not detected in the groundwater samples, and that the sheen is no longer present, the need for additional investigation/remediation is not required.

Attached are the correspondences relating to the submission of the Confirmed Discharge Notification (CON) form. Although the form was completed for the online upload, submittal was not required since the discharge was not confirmed; therefore the form was not required.

I want to apprise you that I have made several attempts to submit a Confirmed Discharge Notice I have attached through the online portal both yesterday (Monday) and today (Tuesday) for a CDN due today.

Number or a screen shot of tab #8 for the submission process (where you enter the Communication Center shot is for the Incident Number) . You can see that the number entered was rejected as invalid. The screen CCN Report from the CCN number, but I got the same result for the Incident number. I have also attached the I did call the Duty Data Miner. The CCN number entered is correct for the spill for which this CDN is intended .

I. had originally called because I was having trouble submitting the confirmed discharge notification (CON) through the on line portal because the CCN was coming up as invalid. You informed that this was because the Incident Status was 'ER Closed'. You changed the status so I could submit the CON. Later today, I received the EPH laboratory analytical results for groundwater (the apparent spill was by transforme rs in the switch yard) were ND (non-detect) showing that the spill was not confirmed. I would like to request that the Incident Status be changed back to closed. PSEG Nuclear will be submitting the 30-day Spill Report in accordance with their DPCC/DCR plan.
