REQUESTS FOR HEARING SUBMITTED WITH RESPECT TO LICENSE APPLICATION OF INTERIM STORAGE PARTNERS LLC FOR THE WCS CONSOLIDATED INTERIM STORAGE FACILITY (DOCKET NO. 72-1050-ISFSI)
The Office of the Secretary received two requests for hearing in response to the application of Interim Storage Partners LLC for the WCS Consolidated Interim Storage Facility (Docket No.
72-1050-ISFSI), which was published in the Federal Register at 83 Fed. Reg. 44070 (August 29, 2018).
The first request was submitted by counsel for Beyond Nuclear, Inc. via Electronic Information Exchange (EIE) on October 3, 2018, and can be found in ADAMS under package accession number ML18276A242. The second request was submitted via EIE on October 29, 2018, by counsel for Permian Basin Land and Royalty Organization (PBLRO) and Fasken Land and Minerals (Fasken). The PBLRO/Fasken request is located in ADAMS under accession number ML18302A412. Both requests and supporting documents are also available on the Electronic Hearing Docket. These requests for hearing are being referred to you for appropriate action in accordance with 10 C.F.R. § 2.346(i).
In addition , a Motion to Dismiss Interim Storage Partner's license application was filed by Fasken/PBLRO. Initially the motion , which also moved for dismissal of the Holtec license application, was filed only on the EIE docket of Holtec (ML18257A329), but it was subsequently filed on the WCS EIE docket as well (ML18271A244). By Order of the Secretary, dated October 29, 2018, (ML18302A329), the motion is being referred to the Atomic Safety and Licensing Board Panel for consideration as a petition under 1O C.F.R. § 2.309.
Finally, a Joint Motion to Establish Briefing Schedule for Fasken 's and PBLRO's Motion to Dismiss as Referred to the ASLBP for Consideration Under 10 C.F.R. § 2.309 was subm itted by the parties on November 7, 2018, (ML18311A267). This motion is also being referred for Board action .
This referral memorandum is being served on the E-Filing service list for the WCS Consolidated Interim Storage Facility proceeding, Docket No. 72-1050-ISFSI.
