II. Background In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C.

Chapter 35), the NRC is requesting public comment on its intention to request the OMBs approval for the information collection summarized below.

1. The title of the information collection: 10 CFR part 150, Exemptions and Continued Regulatory Authority in Agreement States and in Offshore Waters Under Section 274 of the Atomic Energy Act of 1954.
2. OMB approval number: 3150-0032.
3. Type of submission: Extension.
4. The form number, if applicable:

5. How often the collection is required or requested: One-time or as-needed.
6. Who will be required or asked to respond: Thirty-seven Agreement States who have signed Section 274(b)

Agreements with the NRC plus the States of Wyoming and Vermont who have provided applications to become Agreement States. In total, 39 states will be asked to respond.

7. The estimated number of annual responses: 8.

9. The estimated number of hours needed annually to comply with the information collection requirement or request: 190.
10. Abstract: The Nuclear Regulatory Commission (NRC) regulations in part 150 of Title 10 of the Code of Federal Regulations (10 CFR), provide certain exemptions to persons in Agreement States from the licensing requirements contained in Chapters 6, 7, and 8 of the Atomic Energy Act of 1954, as amended, and certain regulations of the Commission. The regulations in 10 CFR part 150 also define the Commissions continued regulatory authority over certain Agreement State activities.

III. Specific Requests for Comments The NRC is seeking comments that address the following questions:

1. Is the proposed collection of information necessary for the NRC to properly perform its functions? Does the information have practical utility?
2. Is the estimate of the burden of the information collection accurate?
3. Is there a way to enhance the quality, utility, and clarity of the information to be collected?
4. How can the burden of the information collection on respondents be minimized, including the use of automated collection techniques or other forms of information technology?

The U.S. Nuclear Regulatory Commission (NRC) invites public comment on the renewal of Office of Management and Budget (OMB) approval for an existing collection of information. The information collection is entitled, NRC Form 398, Personal Qualification StatementLicensee.

7. The estimated number of annual responses: 1,074.

10. Abstract: NRC Form 398 is used to transmit detailed information required to be submitted to the NRC by a facility licensee on each applicant applying for new and upgraded licenses or license renewals to operate the controls at a nuclear reactor facility. This information is used to determine that each applicant or renewal operator seeking a license or renewal of a license is qualified to be issued a license and that the licensed operator would not be expected to cause operational errors and endanger public health and safety.
