RIVER BEND STATION - ACKNOWLEDGMENT OF RESPONSE TO NRC
BASELINE INSPECTION REPORT 05000458/2018012 AND DENIAL OF
NON-CITED VIOLATIONS
Dear Mr. Maguire:
This letter acknowledges your August 23, 2018, (ML18235A636) correspondence in response to
U.S. Nuclear Regulatory Commission (NRC) Inspection Report 05000458/2018012,
(ML18194A413) dated July 18, 2018. This NRC Inspection Report documented two non-cited
violations (NCVs) that were the subject of your response: (1)05000458/2018012-05, Green NCV
of 10 CFR 50, Appendix B, Criterion V, Instructions, Procedures and Drawing (Example 2
portion only) for Failure to Develop an Adequate Operational Decision-Making Issue for
Compensatory Measures Related to a Degraded Condition of the Feedwater System Sparger
Nozzles, and (2)05000458/2018012-07, Severity Level IV NCV of 10 CFR 50.59, Changes,
tests and experiments, for Failure to Perform 10 CFR 50.59 Evaluation for Main Feedwater
System Sparger Nozzle Damage. The NCVs enclosed with Inspection Report 05000458/2018012 required you to respond in writing within 30 days if you contested the
violations. On August 14, 2018, you received an extension of the 30 days from the NRC to
August 24, 2018.
On August 23, 2018, the NRC received a letter from you contesting these two NCVs. The
NRC is currently reviewing your basis for contesting the violations in accordance with Part I,
Section 2.2.7 of the Enforcement Manual. Accordingly, we will provide the results of our
evaluation by written response within 90 days of the receipt of your letter.
