NRC-2018-000612 Appeal NRC-2018-000078 On behalf of the U.S. Nuclear Regulatory Commission (NRG), I am responding to your letter dated June 12, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA} request NRC-2018-000078, which was seeking the second quarter Operating Plan FY2013 (NRC-2018-000078). Specifically, you appealed the "full denial of the requested information".
Acting on your appeal, I have reviewed the records for this case and have determined that this case is not appealable. As stated in our response to NRC-2018-000078, your request is a duplicate request of FOIA/PA 2016-0117, which you submitted 11/05/2015, seeking pages 1 -
100 of ML13149A079 (which is the Second Quarter Operating plan for FY2013).
FOIA/PA 2016-0117 was closed December 01, 2015.
Please also note that this document was previously requested arid denied in full in FOIA 2013-0261 and the decision was affirmed on appeal in FOIA 2013-0021A.
For this reason, your appeal has been administratively closed.
