Dear Mr. Tarver:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated June 12, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA) request NRC-2018-000345, which was seeking records within the date range 12/01/2013 through current date pertaining to the deployment, activation, implementation, installation, initialization and/or development of any devises, equipment, communication
- systems, satellite systems, or support systems, use of existing equipment, newly developed or legacy systems for the pu.rpose of tracking, surveilling, listening, targeting or harming any persons (NRC-2018-000345). Specifically, you appealed the "full denial of the requested search for records".
Acting on your appeal, I have reviewed the records for this case and have determined that this case is not appealable. As stated in our response to NRC-2018-000345, your request was not considered "perfected" and the agency administratively closed the file on this matter since NRC staff confirmed that the subject request is overly broad. As written, it would require an
~xtensive time conducting manual and electronic searches throughout the agency.
