COMMENTS ON JULY 19, 2018, LETTER TO THE U.S NUCLEAR REGULATORY COMMISSION REGARDING HOLTEC INTERNATIONALS APPLICATION FOR A SPECIFIC LICENSE FOR THE PROPOSED HI-STORE CONSOLIDATED INTERIM SPENT FUEL STORAGE FACILITY IN LEA COUNTY, NEW MEXICO (DOCKET NUMBER: 72-1051)

Dear Mr. Singh:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated July 30, 2018, requesting that the Commission denies a July 19, 2018, request by Mr. Terry J. Lodge and others to extend the scoping comment period, suspend the opportunity to request a hearing, and petition for leave to intervene on Holtec Internationals (Holtecs) application for a specific license for the proposed HI-STORE Consolidated Interim Spent Fuel Storage Facility. The NRC published a notice of opportunity to request a hearing and to petition for leave to intervene in the Federal Register on July 16, 2018 (83 FR 32919).

The NRC responded to the July 19, 2018, request by Mr. Terry J. Lodge and others, on July 30, 2018 [NRC Agencywide Documents Access and Management System (ADAMS) Accession No. ML18211A182]. In its July 30, 2018, response, the NRC staff explained that it was not planning to further extend the scoping period. The NRC staff also explained that any request to modify the 60-day deadline for intervention on the Holtecs application is determined by the Commission itself, not by the NRC staff.
