Dear Mr. Tarver:

NRC-2018-000601 Appeal NRC-2018-000071 On behalf of the U.S. Nuclear Regulatory Commission (NRG), I am responding to your letter dated June 12, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA) request NRC-2018-000071, which was seeking all internal/external communication related to FOIA request 2017-0034 and Michael Ravnitzky's October 10, 2016 Declassification Review request. Specifically, you appealed the "full denial of the requested search".

  • Acting on your appeal, I have reviewed the records for this case and have determined that this case is not appealable. As stated in our response to NRC-2018-000071, the scope of your request, as written, is ve.ry broad.and exceeds the 100 pages free of charge. Since you stated that you do not agree to pay any fees, and you were denied. a fee waiver, you are entitled to 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> search time free of charge as well as 100 pages free of charge as a non-excepted reque~ter without incurring any fees.

You failed to provide the requested clarification on the scope of your request to us. As a non-excepted requester, it is incumbent upon you, as the requester, to fashion a request that asks for records within the 2 -hour search time and 100 pages free of charge threshold for which no fee would be owed if you are unwilling to pay fees.

For this reason, your appeal has been administratively closed.
