On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated June 12, 2018, in which you appealed the agency's decision related to your Free~om of Information Act (FOIA) request NRC-2018-000020, which was seeking the "DOE-COE agreement". Specifically, you appealed the denial of information.
Acting on your appeal, 1. have reviewed the records for this case and have determined that this case is not appealable. As stated in our response to NRC 2018-000020 to you, the description of your FOIA request as written, "DOE-COE agreement," is very broad and without additional
- clarifications as to what specific document you are seeking, the NRC is unable tb identify the requested agreement. Therefore, we recommended you contact the Department of Energy (DOE) directly and provided their address to you.
You failed to provide the requested clarification on the scope of your request to us. As a non-excepted requester, it is incumbent upon you, as the requester, to fashion a request that asks for records within the 2 -hour search time and 100 pages free of charge threshold for which no fee would be owed if you are unwilling to pay fees.
For this reason, your appeal has been administratively closed.
