Dear Mr. Tarver,

On behatf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated* May 27, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA) request NRC-2018-000362. In that request you soµght aall records of the Federal Real Property Profile (FRPP) for.the NRC." On May 18, 2018, the NRC responded that the scope of your request, as written, was sufficiently broad such that it would *exceed the 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> of search time and 100 pages of duplication to which you are entitled without charge.

You have previously indicated your unwillingness-to pay fees and have been denied a fee waiver. Thus, the NRC closed your request on the basis that it would Incur fees. You now appeal the* NRC's denial to conduct a search for records.

Acting on your appeal, I have determined that the scope of your initial request was construed too broadly, and that the NRC possesses less than 100 pages of responsive records. Therefore I have granted your appeal and am providing the records possessed by the NRC.

  • This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you can seek judicial review of this decision in a district court of the United States in the district in which you reside or have your principal place of business, in the district yvhere the agency's records are situated, or in the District of Columbia.
  • As part of the 2007 FOIA amendments, the Office of Government lnf9nnation Services (OGIS) was created to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation. Using OGIS ~rvices does not .
