RESPONSE TO SHOSHONE-BANNOCK TRIBES COMMENTS ON THE PROPOSED WYOMING STATE AGREEMENT APPLICATION
Dear Chairman Small:
This letter is in response to your July 26, 2018, comment letter on the proposed Agreement between the State of Wyoming and the U.S. Nuclear Regulatory Commission (NRC) and the draft NRC staff assessment on the proposed Agreement, both of which were published in the Federal Register in June and July of this year. The proposed Agreement is for the State of Wyoming to assume regulatory authority for a subcategory of source material involved in the extraction or concentration of uranium or thorium in source material or ores at uranium or thorium milling facilities and the management and disposal of byproduct material as defined in 11e(a) of the Atomic Energy Act of 1954.
The NRC appreciates the time and effort that the Shoshone-Bannock Tribes took to develop these comments and will include them in the NRC staffs Commission paper on the proposed Wyoming Agreement.
In response to your request for a webinar on the NRCs Agreement State process and the NRCs regulatory and oversight roles with respect to Agreement States, the NRC staff contacted Ms. Talia Martin, Director, Shoshone-Bannock Tribes, Tribal Department of Energy, to discuss the request and the desired timing for the webinar. To maximize participation, the NRC staff is evaluating the possibility of holding the webinar in September 2018 as requested by the Tribe to support the availability of the tribal members. The staff is working with Ms. Martin to coordinate the webinar content and timing.
The NRC welcomes the opportunity to meet with the Fort Hall Business Council in Idaho for a government-to-government meeting, as requested in your letter. Based on feedback from Ms.
Martin, a suggested meeting time frame would be September or October 2018, following the webinar. The NRC staff will work with Ms. Martin to coordinate the agenda topics and the meeting date.
