31310018P0046 SECTION B - Supplies or Services/Prices B.1 BRIEF PROJECT TITLE AND WORK DESCRIPTION (a) The title of this project is: NRC Child Care Subsidy Program Bridge Contract (b) Summary work description: This is a non-personal services contract for Administration Support Services for the U.S. Nuclear Regulatory Commissions (NRC) Child Care Subsidy Program.

31310018P0046 SECTION C - Statement of Work C.1. Background The NRC/OCHCO provides benefits, counseling and personnel services to NRC employees, which enhances the balance of work and family responsibilities and assists NRC in recruiting and retaining the skills necessary to accomplish its mission. As such, OCHCO plans, implements, and monitors a full range of employee benefits; plays an active leadership role in the development of new initiatives; and serves as an agency-wide clearinghouse for information on employee benefits and other related programs.

Congress enacted Public Law 107-67 (hereinafter referred to as the Act), which permits Federal agencies to assist their lower income Federal employees with the costs of child care. This legislation allows Federal agencies to provide subsidies directly to the child care provider and thus, can reduce the amount of money that parents pay for childcare. To be eligible to participate in this program, child care provided must be a family child care home or child care center. Either type of care must be licensed and/or regulated by the State and/or local authorities where the service is provided.

C.2 Objective The objective of this requirement is to obtain support services from the contractor to assist in administering the NRCs Child Care Subsidy Program.

C.3 Scope of Work/Tasks The contractor shall handle all administrative tasks associated with the child care subsidy program, including providing information to respond to requests for information under the Freedom of Information Act or Privacy Act. The NRC shall provide funding on the subsequent contract, for the purpose of the contractor to provide payment to child care providers as tuition assistance funds on behalf of the NRC. The NRC currently has a limit of for tuition assistance for the period of performance of this bridge contract. However this limit may be adjusted at the NRCs discretion.

Contractor tasks include:

C.3.1 Determine Subsidy Eligibility and Subsidy Amount The contractor shall provide applications for the Child Care Subsidy Program (NRC Form 734) to NRC employees via email, as requested. Employees may also obtain NRC Form 734 from the NRCs Child Care Subsidy Program webpage, the NRC Forms Library, or from OPM.gov (OPM Form 16440). NRC staff will submit completed applications directly to the contractor, via email to ywondwossen@feea.org. The contractor shall determine the employees eligibility and the subsidy amount based on the formula provided in the NRCs Child Care Subsidy Program Model in Attachment 1. The NRC may adjust the total family income limits and percentages.

All full-time and part-time NRC employees are eligible to apply for child care subsidy if they meet the income requirements and use a licensed or regulated child care provider.

Applications may be submitted to the contractor at any time. The contractor shall first award child care subsidy benefits to NRC employees whose total family income (TFI) is Page 4 of 19

$50,000 or less, before considering requests from employees whose TFI is between

$50,001 and $73,000. When considering requests from employees that are in the same income category, the contractor shall approve the applicant with the lowest TFI before requests from employees with a higher TFI. Review/approvals shall continue in this way until all eligible requests have been filled or until the funds allocated by the NRC to the program have been exhausted, whichever comes first. If all requests are filled and funds remain unexpended, the contractor shall honor all additional requests from new employees or whose TFI qualifies them for the program during the year. The contractor shall advise NRC employees in early April of each year that they must re-apply to the program, submitting their current years income tax forms as proof of income. The contractor shall award a new round of child care subsidy following the same protocol as described above.

As provided in the Act, for purposes of this program, a child is considered to be:

(a) A biological child who lives with the Federal employee; (b) An adopted child; (c) A stepchild; (d) A foster child; (e) A child for whom judicial determination of support has been obtained; or (f) A child to whose support the Federal employee, the employees spouse, or the employees domestic partner makes regular and substantial contributions.

The Act covers the children of Federal employees, excluding contractor employees, from birth through age 12 (under the age of 13) and disabled children through age 17 (under the age of 18). A disabled child is defined as one who is unable to care for himself or herself based on a physical or mental incapacity as determined by a physician or licensed or certified psychologist.

C.3.2 Notification of Applicant and Child Care Provider The contractor shall notify the applicant and child care provider, via email, of the amount of subsidy that each family will receive and the effective dates within 10 working days of receipt of the application. The notification shall also include a statement that the NRC employee may appeal a decision by emailing the NRC Child Care Subsidy Program Coordinator (NRC COR).

C.3.3 Estimated Funding for Subsidy Payments The table below provides an estimate of the total tuition assistance provided by the NRC for the base period of the bridge contract.

31310018P0046 C.3.4 Ensure Child Care Providers are Licensed/Regulated by State and/or Local Authorities The contractor shall ensure that each child care provider that receives NRC funds for the NRCs Child Care Subsidy Program are licensed and/or regulated by the State and/or local authorities. In doing so, the contractor shall:

a) Require that applications from NRC employees include a copy of their latest license and/or statement of compliance from the appropriate State and/or local authorities from each child care provider who would receive funds under the program.

b) Require that applications from NRC employees include a completed copy of OPM Form 1644 for each provider who would receive funds under this program.

c) Ensure that licensed child care providers are informed that if, for any reason, the provider is no longer licensed and/or regulated by the State and/or local authorities, the provider shall immediately notify the contractor and the NRC employee whose child is enrolled in the child care program. In such cases, the Contractor shall not provide funds to the provider.

C.4 Provide Payment to Child Care Providers The contractor shall request a monthly invoice from the child care provider for each child that receives a subsidy from the NRC, in the amount of the approved subsidy agreement. The contractor shall verify whether/what services were received and provide payment to the applicable providers based on the invoiced amount within 30 days after the date of the invoice.

The contractor shall pay the subsidy directly to the child care provider. The contractor shall:

a) Ensure that the child care provider submits a written invoice, on a monthly basis, to the contractor. The contractor shall require both the child care provider and the parent to certify on the invoice that the services were provided, prior to the provider sending the invoice to the contractor for payment.

b) Ensure that notification of the child care subsidy awards provided to the employee and child care provider are quoted as weekly amounts and that the invoices received from the child care providers are prepared using full week amounts, unless services for the child end in the middle of a particular week.

C.5 Reporting Requirements C.5.1 Monthly Letter Status Report The contractor shall submit a Monthly Letter Status Report (MLSR) to the COR, via email, by the 15th day of the following month. The report shall be transmitted in a format that is readable using Microsoft Word and be sent to the COR as an email attachment. The MLSR shall contain the following information:

31310018P0046 a) The number of NRC applications received by organizational subcomponent (e.g., Office of Nuclear Reactor Regulation, Office of Small Business and Civil Rights) and whether located in headquarters or in a regional office; b) The number of NRC employees who submitted an application but were deemed by the contractor to be ineligible; c) The number of NRC employees who submitted an application but were denied due to lack of obligated funding on the contract; d) The number of NRC employees who qualified for a subsidy and who are receiving the subsidy as of the date of that report; e) The number of children enrolled whose NRC parents receive the child care subsidy; f) The amount of subsidies disbursed in the prior month; g) The total family income of each NRC family that receives a child care subsidy broken down to reflect the salary for each partner in the family; h) The amount of the child care subsidy for each recipient; i) The GG grade level of the NRC employee; j) The name and address of each child care provider that provides services for the subsidy recipients; k) The number of total applicants for the month; l) The number of applications in process; m) The number of new child care subsidies; n) The remaining balance of the agencys funds; and o) Financial information for tax purposes: The name of each NRC employee whose child care provider received tuition assistance that month and the amount of subsidy received by the employees child care provider.

C.5.2 IRS Form 1099-MISC No more than 30 days after the end of the calendar year, the contractor shall distribute a completed IRS Form 1099-MISC to each child care provider that received payment(s) under the NRC Child Care Subsidy Program.

C.5.3 Final Report The contractor shall submit a Final Report to the COR containing the information listed above in section C.5.1 and any additional information that may be required to be reported by the NRC to OPM or Congress. The contractor shall provide the report to the COR, via email, no more than 30 days after the end of the contract (or earlier, if requested by the COR).

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

The Nuclear Regulatory Commission (NRC) uses Compusearch Software Systems secure and auditable two-way web portal, FedConnect, to communicate with vendors and contractors.

FedConnect provides bi-directional communication between the vendor/contractor and the NRC throughout pre-award, award, and post-award acquisition phases. Therefore, in order to do business with the NRC, vendors and contractors must register to use FedConnect at https://www.fedconnect.net/FedConnect. The individual registering in FedConnect must have authority to bind the vendor/contractor. There is no charge for using FedConnect. Assistance with FedConnect is provided by Compusearch Software Systems, not the NRC. FedConnect contact and assistance information is provided on the FedConnect web site at https://www.fedconnect.net/FedConnect.

D.4 USE OF AUTOMATED CLEARING HOUSE (ACH) ELECTRONIC PAYMENT/

REMITTANCE ADDRESS The Debt Collection Improvement Act of 1996 requires that all Federal payments except IRS tax refunds be made by Electronic Funds Transfer. lt is the policy of the Nuclear Regulatory Commission to pay government vendors by the Automated Clearing House (ACH) electronic funds transfer payment system. Item 15C of the Standard Form 33 may be disregarded.

D.5 ELECTRONIC PAYMENT (DEC 2017)

The Debt Collection Improvement Act of 1996 requires that all payments except IRS tax refunds be made by Electronic Funds Transfer. Payment shall be made in accordance with FAR 52.232-33, entitled Payment by Electronic Funds Transfer-System for Award Management.

To receive payment, the contractor shall prepare invoices in accordance with NRCs Billing Instructions. Claims shall be submitted through the Invoice Processing Platform (IPP)

(https://www.ipp.gov/). Back up documentation shall be included as required by the NRCs Billing Instructions.

D.6 BILLING INSTRUCTIONS FOR FIXED-PRICE TYPE CONTRACTS (JULY 2017)

General: During performance and through final payment of this contract, the contractor is responsible for the accuracy and completeness of data within the System for Award Management (SAM) database and the Invoice Processing Platform (IPP) system and for any liability resulting from the Governments reliance on inaccurate or incomplete SAM and/or IPP data.

Electronic Invoice/Voucher Submissions: Invoices/vouchers shall be submitted electronically to the U.S. Nuclear Regulatory Commission (NRC) is through the Invoice Processing Platform (IPP) at www.ipp.gov.

Agency Payment Office: Payment will be made by the office designated in the contract in Block 18a of Standard Form 1449.

Supporting Documentation: Any supporting documentation required to substantiate the amount billed shall be included as an attachment to the invoice created in IPP. If the necessary supporting documentation is not included, the invoice will be rejected.

Currency: Invoices/Vouchers must be expressed in U.S. Dollars.

1. The current established upper limit or threshold for total family income for eligibility is $70,000.00. The NRC may adjust this amount in the future as warranted.
