Items of Interest Week Ending July 27, 2018 On June 14, 2018, the Regional Administrator, Region II, issued a decision on a Differing Professional Opinion (DPO) involving issuance of a more-than-minor Green non-cited violation (NCV) for an operational event, during shutdown, at Watts Bar Unit 2. On December 12, 2017, an NRC employee submitted a DPO regarding the documentation of the event in an inspection report. The individual stated that the event had insignificant or no safety significance and documenting the event as a Green NCV was contrary to the fundamental tenants of the Reactor Oversight Process. On April 23, 2018, an Ad Hoc Review Panel provided the results of its independent review to the Regional Administrator, Region II. The panel concluded that the issuance of the inspection finding by the Region II office was appropriate and consistent with program guidance and, in large part, within the subjectivity provided in the guidance contained in Inspection Manual Chapter (IMC) 0612. Additionally, the DPO panel concluded that further program guidance and clarification was warranted to ensure that more-than-minor determinations did not factor or aggregate factors outside the existing IMC 0612 guidance.

Lastly, further inspector training on more-than-minor determinations is appropriate. Based on a review of the original DPO, the panel's report, and additional comments provided by the DPO submitter in response to the panel's report, the Regional Administrator, Region II, agreed with the panel's conclusions and recommendations.
