- 2) Letter from Matt Allen (GLE) to Patricia Holahan (NRC), "Submission of Facility Clearance for Global Laser Enrichment" date June 24, 2009, MFN-09-416 Pursuant to 10 CFR 95.17(a)(1 ), GE-Hitachi Global Laser Enrichment, LLC (GLE), as a licensee under Docket 70-7016, SNM-2019, hereby submits a twenty-sixth amendment to its original foreign ownership, control, or influence (FOCI) information submittal supporting the NRC facility clearance (FCL) granted to GLE.
As stated in GLE's May 26, 2016 letter to NRC (Reference 1, above), on April 29, 2016, GLE's controlling parent companies, GENE Holding LLC and GE-Hitachi Nuclear Energy Americas LLC (the "GE Parties") entered into a non-binding Term Sheet with Silex Systems, Limited (Silex) whereby a Silex subsidiary may purchase the equity interest of the GE Parties, subject to US government approvals and other commercial conditions precedent (the "Term Sheet"). Per the Reference 1, above, GLE submitted.
an SF-328 and updated OODEP based on the financial arrangements discussed in the Term Sheet. Subsequently, on June 11, 2018, Silex terminated the Term Sheet with the GE Parties. In accordance with 10 CFR 95.17 for notification to NRC within 30 days P 0

2 of any significant events or changes that may affect GLE status concerning foreign ownership, control or influence, GLE is making this submittal.
With the termination of the Term Sheet, the SF-328 reverts to submittal in Reference 2, above. In conjunction with this SF-328 update, GLE also submits the enclosed amendment to the Owners, Officers, Directors, and Executive Personnel (OODEPs) listing. The GE Parties' OODEPs have not changed. The GLE OODEP listing is being changed to reflect the deletion of the Board Observer (non-voting) status for Silex. contains Personally Identifiable Information as defined in 1 O CFR 2.390, and that Enclosure has been identified and marked accordingly.
