Dear Mr. Regan:

This letter concerns the eligibility of WPPSS Nuclear Project No.

2 (HWNP-28) to dispense with the cost-benefit analysis contemplated by Section II.D of Appendix I to 10 CFR 50, in accordance with the September 4,

1975 amendments

thereto, including the Annex to Appendix I.

Since the application for WNP-2 (which was filed on August 19, 1971) and since the issuance of the construction permit (on March 19, 1973), the NRC has adopted (and subsequently amended)

Appendix I to 10 CFR 50, applicable to applications filed after January 21, 1971; The provisions of Section II.D. of Appendix I, as

amended, allow the option of dispensing with the cost-benefit analysis and with consideration of further augments to the radwaste
system, so long as WNP-2 (and all reactors at the site together in the case of Hper site" design objectives) satisfies the
February, 1974 concluding statement of the Regulatory Staff which is incorporated as an Annex to Appendix I.

The question of eligibility of WNP-2 to dispense with this Appendix I cost-benefit analysis as to Hper site" limitations has been reviewed by the Regulatory Staff in connection with their review of WPPSS Nuclear Project No.

on November 11, 1975 that "the aggregate doses associated with WPPSS Nuclear Project No. 1, WPPSS Nuclear Project No. 2, and WPPSS Nuclear Project No.

These conclusions were ratified by the Atomic Safety and Licensing Board in its decision pertaining to WNP-1 and WNP-4 of December 22, 1975.

In view of the fact that the Staff has previously evaluated WNP-2 on a per site bas.is under the Annex to Appendix I in the context of the proceeding involving WNP-1 and WNP-4, we are proceeding on the assumption that no further showing is required to demonstrate that WNP-2 is eligible to dispense with the Section II.D. cost-benefit analysis.

A complete description of the WNP-2 radwaste systems and equipment, as well as the plans and technical specifications which are being developed to keep releases of radioactive material in effluents to unrestricted areas as low as reasonably achievable, will be submitted to the Staff with the filing of our Operating License Application which is anticipated to be filed by September 15, 1976.
