EXEMPTION GRANTED TO IMPORT CATEGORY 2 QUANTITIES OF AMERICIUM-241, AMERICIUM-241/BERYLLIUM AND CESIUM-137 WITHOUT PROVIDING AT LEAST SEVEN DAYS ADVANCED NOTICE

Dear Ms. Tolentino:

On June 21, 2018, Halliburton Energy Services submitted a request to the U.S. Nuclear Regulatory Commission (NRC) to obtain a one-time exemption of the notification requirement in Title 10 of the Federal Regulations 10 CFR Part 110.50 (c)(4) to provide at least seven days advanced notification of an import. Halliburton requested the exemption due to riots in the country of origin (Gabon) after they had submitted their original advanced notification of import.

Halliburton expressed concerns that it would be unsafe for the radioactive sealed sources to wait in Gabon until the original shipping date of June 30, 2018, as stated on their advanced notification of shipment.

The NRC determined that, in accordance with 10 CFR 110.10, the requested exemption:

1. Is authorized by law;
2. Is not inimical to the common defense and security; and
3. Does not constitute an unreasonable risk to public health and safety.

The granting of an exemption does not relieve any person form complying with the regulations of other U.S. Federal and/or State government agencies applicable to exports or imports under their authority.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system Agencywide Documents Access and Management System accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html .
