U.S. NUCLEAR REGULATORY COMMISSION VERIFICATION LETTER AND PROPRIETARY DETERMINATION FOR ERRATA FOR BWRVIP-26-A: BWR VESSEL AND INTERNALS PROJECT, BWR TOP GUIDE INSPECTION AND FLAW EVALUATION GUIDELINES (EPID L-2018-TOP-0024)
Dear Mr. Hanley:
By letter dated June 12, 2018, the Boiling Water Reactor (BWR) Vessel and Internals Project (BWRVIP) submitted to U.S. Nuclear Regulatory Commission (NRC) an errata for BWRVIP-26-A, BWR Vessel and Internals Project, BWR Top Guide Inspection and Flaw Evaluation Guidelines (Agencywide Documents Access and Management System Accession No. ML18165A152). Also submitted was a June 11, 2018, affidavit executed by Neil Wilmshurst, Vice President and Chief Nuclear Officer requesting that the information contained in revised page be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations, Section 2.390 (10 CFR 2.390).
A nonproprietary copy of this document (ADAMS Accession No. ML18165A152) has been placed in the U.S. Nuclear Regulatory Commissions (NRCs) Public Document Room and added to the NRC Library in ADAMS.
In its letter, the BWRVIP states that BWRVIP-26-A contains an error regarding Hatch Unit 2 Top Guide seismic force ratio shown in Figure A-1. Specifically, the seismic force ratio of 0.10 in the Y-Axis of Figure A-1 should have been plotted as 0.18. The revision to Figure A-1 does not change the conclusions stated in Appendix A.
Based on its review of the information, the NRC staff agrees with the revision provided.
With respect to the request for withholding the information in the corrected page, EPRI detailed the reasons in its affidavit.
The NRC staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390. On the basis of the statements in the affidavit, the NRC staff has determined that the submitted information contains proprietary, commercial information and should be withheld from public disclosure.
T. Hanley Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure under 10 CFR 2.390(b) (5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the agency may send copies of this information to its consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC staff.
You also should understand that the NRC staff may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
