Dear Mr. Brown:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated April 26, 2018, requesting a prorated materials license fee for the period of October 1, 2017 through November 1, 2017. Fee proration regulation is outlined in Title 10 CFR Part 171 under, specifically in 171.16 (3).
10 CFR 171.16(3) In accordance with 171.17, each person identified in paragraph (a)(1) of this section shall pay the applicable annual fee for each license the person holds during the fiscal year. Annual fees will be prorated for new licenses issued and for licenses for which termination is requested and activities permanently ceased during the fiscal year as provided in 171.17.
We have reviewed the license expiration and termination request documentation that was previously sent, and we have made the determination that the letter withdrawing your renewal request was sufficient to continue with the termination request. Therefore, we conclude that Sony Electronics should be invoiced at a rate of 50% of the annual fee which is spelled out in our annual fee rule. We will include the invoice with this letter.
