CYTEC INDUSTRIES, INC. -NRC INSPECTION NO. 03015161/2018001 AND NOTICE OF VIOLATION, AND YOUR LETIER DATED MAY 10, 2018

Dear Mr. Fenton:

This letter refers to your May 10, 2018, correspondence, in response to our April 13, 2018, letter. The Notice of Violation enclosed with our April 13, 2018, letter cited four violations which were identified by the NRC during an inspection at your Willow Island, West Virginia facility.

The violations involved were: (1) transfer of control of the license without notification and approval by the NRC; (2) possession under 10 CFR 31.5 of unused devices for more than two years; (3) failure to leak test devices at intervals not exceeding 3 years; and (4) failure to calibrate a survey meter at least annually.

All four violations were classified as Severity Level IV. You have disputed the first violation, and described the basis for your dispute. NRC is in the process of reviewing the basis of your dispute for that violation and will notify you of the results of our review when the review has been completed.

You provided a description of your corrective actions for the remaining three violations.

Thank you for informing us of the corrective and preventive actions documented in your letter. These actions will be examined during a future inspection of your licensed program. In accordance with 10 CFR 2. 390 of the NRC's "Rules of Practice," a copy of this letter and your response, if you choose to provide one, will be made available electronically for public inspection in the NRC Public Document Room or from the NRC document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
