NRC INSPECTION REPORT NOS. 50-280/91-37 AND 50-281/91-37
On March 16, 1992 we informed you that we were evaluating your response of
February 28, 1992, to our Notice of Violation issued on February 3, 1992,
concerning activities conducted at your Surry facility.
We have completed our
enforcement review of this response, in which you denied the subject violation,
and have decided to withdraw the violation.
Accordingly, we will adjust our
records to reflect this decision.
Based on our review of the Technical Specifications and your ASME Code Inquiry
IN-91-017, we understand how you could arrive at the conclusion that the
Technical Specifications leakage limits, and not ASME Section XI IWA-5250 Code
requirements, were the governing requirements for determining operability with
a known leakage rate.
We are continuing to review the adequacy of. your
interpretation and will inform you of the results at a later date.
Your cooperation in this matter is appreciated.
