VIRGINIA ELECTRIC AND POWER COMPANY SURRY POWER STATION UNITS 1 AND 2 NORTH ANNA POWER STATION UNITS 1 AND 2 CHANGE OF NRC NOTIFICATION PROCEDURE Serial No.90-676 NL&P/TAH RS Docket Nos. 50-280 50-281 50-338 50-339 License Nos. DPR-32 DPR-37 NPF-4 NPF-7 In the past, Virginia Electric and Power Company has notified the NRC pursuant to 1 OCFR50.72(8)(2)(vi) following notification to any government agency of an event at North Anna or Surry. The subsection requires NRC notification when "notification to other government agencies has been or will be made." Our interpretation of "other government agencies" had included any agency at the federal, state or local level.
"Government agency" is defined in 1 OCFRS0.2 as an agency of the Federal government under the jurisdiction of the executive branch.
Under this definition, state and local agencies are outside the scope of the regulation. Based on that interpretation, it is our intent to no longer notify the NRC solely because a state or local agency has been notified of an event occurring at North Anna or Surry.
For example, we notify the Virginia Department of Emergency Services when transport of individuals offsite to a local hospital has occurred and radioactive materials are not involved. In the past, based on the state

e Docket Nos. 50-280&281 50-338&339 Seri~No.90-676 We believe this change will result in eliminating formal notifications to the NRC that have no impact on protecting public health and safety. However, we will continue to provide informal notification to the NRC Resident Inspectors of these events. Notification to the NRC pursuant to any other requirement of 1 OCFRS0.72 is unaffected by this change.
