ISSUANCE OF SCHEDULAR EXEMPTION FROM THE REQUIREMENTS OF 10 CFR PART 50, APPENDIX J, FOR SURRY POWER STATION, UNIT 1, REGARDING DELAY OF NEXT REQUIRED TYPE A LEAKAGE RATE TEST (TAC NO. M92163)

Dear Mr. O'Hanlon:

By letter dated April 28, 1995, you requested a one-time schedular exemption to delay performance of a Type A test, as required by 10 CFR Part 50, Appendix J, for a period of approximately 18 months.

The NRC staff has reviewed the information provided in support of your schedular exemption request.

On the basis of the submitted information and as discussed in the enclosed Exemption, the NRC staff has concluded that the performance of a Type A test during the 1995 refueling outage is not necessary to achieve the underlying purpose of Appendix J, i.e., an essentially leak tight containment.

We find that granting the Exemption from the requirements of 10 CFR Part 50, Appendix J, Section 111.D.l.(a), is authorized by law, will not present an undue risk to public health and safety, is consistent with the common defense and security, and meets the special circumstances described in 10 CFR 50.12(a)(2)(ii). Accordingly, your request for a schedular exemption to delay performance of the Type A test until the 1997 refueling outage is granted.

A copy of the Exemption is enclosed. The Exemption has been forwarded to the Office of the Federal Register for publication.
